Definitions

In these Terms and Conditions, "we" or "us" means WinSpirit Casino and includes its subsidiaries, related companies, successors and assigns; "you" refers to you the customer; "agreement" means these terms and conditions.

Changes to our Services

We may change or discontinue any of our services at any time in our sole discretion without notice. If we make changes that affect your use of a service, we will give you reasonable prior notice. We also reserve the right to add new services which are subject to these Terms and Conditions.

Payment Terms

You agree to pay us for all goods or services provided by us at the price set forth on our website. You must provide valid payment information to use our services. If we do not receive timely payment, you will be in default. All prices listed on our site are in CAD and include applicable taxes.

Refund Policy

If you cancel your account within 30 days of sign-up, we will refund your fees in full less any charges incurred for service rendered prior to cancellation. If you request a refund after the first 30 days or if you have used more than a nominal amount of our services, no refunds are given.

Intellectual Property

Our website and all content on it, including text, graphics, logos and button icons are owned by us or licensed from third parties. You may not modify, copy, distribute, republish, display, upload, email or transmit any part of our site in any form without the prior written permission of WinSpirit Casino.

Liability

In no event will we be liable to you for consequential damages, including but not limited to loss of use, data, business profits, revenue, contracts and good will even if advised of their possibility. In all other respects, our liability is limited to providing a replacement service or refunding fees in accordance with our Refund Policy.

Governing Law

These Terms and Conditions are governed by the laws of Canada without regard to its conflict of law principles. Any disputes arising out of these Terms must be resolved through binding arbitration as provided for under the Canadian Arbitration Act.

Indemnification

You will indemnify, defend and hold us harmless against all claims or demands made against WinSpirit Casino which arise directly from your breach of any agreement with a third party resulting in loss to that third party.

Termination

We may terminate our services to you at anytime without notice if we determine it is necessary due to actions by you. You agree to delete and remove from all storage media all copies of our software and documentation after termination.

General Terms

All notices required or permitted under these agreements must be in writing, signed by both parties and given personally, via registered mail or delivered electronically through email.
